War Crime

The following list summarizes the alleged war crimes and crimes against humanity for which an arrest warrant has been issued by the International Criminal Court (ICC) against Benjamin Netanyahu, the Prime Minister of Israel.

It is important to note that Israel strongly denies these allegations, asserting that its military actions are conducted in accordance with international law.

๐Ÿ›️ International Criminal Court (ICC) Allegations

On November 21, 2024, the ICC Pre-Trial Chamber I issued arrest warrants for Prime Minister Benjamin Netanyahu (along with former Defense Minister Yoav Gallant) for crimes allegedly committed during the war in Gaza, from at least October 8, 2023, until at least May 20, 2024.

The ICC charges against Benjamin Netanyahu include:

| Category of Crime | Specific Alleged Crime | Description of Conduct |

|---|---|---|

| War Crime | Starvation of civilians as a method of warfare | Allegedly using starvation as a deliberate tactic by intentionally and knowingly depriving the civilian population in Gaza of objects indispensable to their survival, including food, water, medicine, fuel, and electricity, and by impeding humanitarian aid. |

| War Crime | Intentionally directing an attack against the civilian population | Allegedly being criminally responsible, as a superior, for intentionally directing attacks against the civilian population of Gaza. |

| Crime Against Humanity | Murder | Allegedly bearing responsibility for acts of murder committed during the relevant period. |

| Crime Against Humanity | Persecution | Allegedly bearing responsibility for persecution against the civilian population. |

| Crime Against Humanity | Other Inhumane Acts | Allegedly bearing responsibility for other inhumane acts. |

๐Ÿ“ Key Context

 * Legal Status: An arrest warrant from the ICC signifies that the Pre-Trial Chamber found "reasonable grounds" to believe that the accused committed the alleged crimes. It is not a finding of guilt, which can only be determined after a full trial.

 * The ICC's Authority: All 125 member states of the ICC are obligated to arrest Netanyahu and Gallant if they enter their territory. Israel is not a member of the ICC and rejects the court's jurisdiction.

 * The Broader Investigation: The ICC's ongoing investigation in the Situation in the State of Palestine also covers alleged crimes committed in the West Bank (including East Jerusalem), and previous conflicts in Gaza, such as the 2014 Gaza War and the 2018–2019 Gaza border protests.
